1. Introduction

Welcome to Film Vibes ("we", "us", "our" or “Film Vibes”). These Terms and Conditions ("Terms") govern your access to and use of our website, as well as the purchase of any goods and services provided by us.

By placing an order or using our website, you agree to be fully bound by these Terms. If you do not accept them, please do not proceed with any purchase.

2. Definitions

  • "Goods": Refers to second-hand cameras, lenses, accessories, parts, or related items sold by Film Vibes.
  • "Order": Your request to purchase Goods, whether placed via our website, marketplace listings where we are the seller, or other accepted channels.
  • "Pre-order": An Order for Goods that are not currently in stock and will be sourced or imported when available.
  • "Warranty Period": The 30‑day period from the date of delivery, unless a different period is expressly stated in the listing.
  • "Buyer" / "you": The person or entity placing an Order with Film Vibes.

3. Applicability

These Terms apply to all Orders placed with Film Vibes through our website and any marketplace channels where we are the seller. No variation to these Terms shall be binding unless agreed to in writing by a director of Film Vibes.

4. Nature of Second-Hand Goods & Technical Disclaimers

4.1 Acceptance of Condition

By purchasing a pre-owned item, you acknowledge that the Goods are not new and may show signs of wear consistent with their age and prior use. Under the Consumer Protection (Fair Trading) Act (CPFTA), the standard of "satisfactory quality" for second-hand goods takes into account the age, history, and price of the item. You cannot claim a remedy for defects that were specifically disclosed in the listing or which were obvious on reasonable inspection (including from the listing photographs).

4.2 Cosmetic Imperfections

Second-hand cameras and lenses naturally show signs of previous use. You explicitly acknowledge that cosmetic imperfections - including but not limited to scratches, scuffs, paint loss, brassing, rubber wear, minor dents, or leather peeling - that do not impact the mechanical or optical performance of the Goods are standard characteristics and are not considered defects. Such imperfections do not entitle you to a repair, replacement, or refund under our warranty.

4.3 Technical Limitations & Consumables

  • Shutter Count: Any listed shutter count is an estimate based on internal data at the time of listing. We do not guarantee the remaining lifespan of any shutter mechanism.
  • Batteries: Used batteries are consumable items. While we ensure they hold a charge upon arrival, we do not guarantee they will hold a charge equivalent to a new battery.
  • Optics: Minor internal dust in lenses, slight haze that does not affect image quality, and normal age-related imperfections in coatings are standard in vintage optics and are not considered defects unless explicitly described as “fungus”, “heavy haze”, “balsam separation”, or similar.
  • Vintage Metering: Selenium cells and vintage light meters are not guaranteed for perfect accuracy unless explicitly stated.

4.4 No Grading System

  • Film Vibes does not utilize a standardized grading scale (e.g., "Mint", "Exc+"). Every listing includes photographs and a written description of the item’s condition and any known faults.
  • You should review all images and the description, and ask questions before purchasing. The listing, images and any statements in the listing form part of the contract.

4.5 Claims

You cannot claim a remedy for any fault or issue that was:

  • Clearly disclosed in the listing (e.g., “shutter sticking”, “light seals degraded”, “flash not working”);
  • Visible in the listing photographs; or
  • Would have been apparent upon reasonable inspection (including in-person inspection, where offered).

5. Orders, Price & Payment

5.1 Currency & Taxes

All prices are in Singapore Dollars (SGD). Prices are exclusive of GST unless otherwise stated on the checkout page. GST, if applicable, will be added at checkout.

  • Payment: Payment must be completed in full (or the required deposit for pre-orders) using the payment methods shown at checkout.
  • International Buyers: You are solely responsible for any customs duties, import taxes, or levies imposed by your country.

5.2 Pre-orders

  • Deposit: Pre-orders require a 50% non-refundable deposit to secure the item.
  • Cancellation: If you cancel a Pre-order, the deposit is forfeited. If we cancel due to inability to supply the Goods, we will either refund the deposit in full or allow transfer to another item of equivalent value.
  • Timelines: Estimated arrival or delivery dates are indicative only and not guaranteed.

6. Shipping, Delivery & Risk

6.1 Risk of Loss

While we pack all items securely, Film Vibes acts as the shipper on your behalf.

  • Courier Liability: Once the Goods have been handed over to the courier/postal service, liability for loss or damage in transit shifts to the courier service, subject to their terms.
  • Assistance: We are not responsible for loss, delay, or damage that occurs during transit. Any such claims must be filed directly with the courier. We will provide reasonable assistance (e.g., proof of postage) but accept no liability for courier’s negligence.

7. Warranty Policy

7.1 Standard 30-Day Warranty

Unless the listing states otherwise, Goods are covered by a 30-Day Limited Warranty covering mechanical or electronic failures that materially affect the camera’s ability to take photographs or videos under normal use and that were not disclosed in the listing.

7.2 What is excluded (non-exhaustive):

  • Cosmetic issues of any kind
  • Impact, drop, water, sand, or liquid damage
  • User mishandling or modification
  • Fungus growth after delivery
  • Normal consumables (batteries, light seals, mirror bumper foam, etc.)
  • Sensor or shutter curtain cleaning
  • Light meter accuracy unless specifically warranted
  • Issues that were disclosed or visible in the listing

7.3 "As-Is" Items

Items marked "As-Is," "For Parts," or "Untested" are sold with NO WARRANTY. The buyer assumes the entire risk regarding quality and performance.

8. Returns & Dispute Resolution

8.1 Mandatory Unboxing Video

To protect both parties, you are required to record a clear, continuous, unedited unboxing video when opening your package. This is mandatory for any claims regarding:

  1. Physical damage sustained during shipping.
  2. Items Dead-on-Arrival (DOA).
  3. Missing or incorrect items.

Video Requirements:

  • Start filming before opening the package, clearly showing the shipping label and sealed tape.
  • Keep the video continuous (no cuts/edits) while unpacking and inspecting the item.

Assumption of User Mishandling: If physical damage is found on the item and no valid unboxing video is provided, it will be conclusively assumed that such damage was caused by user mishandling after delivery, and the claim will be denied.

8.2 Warranty Returns Procedure

  1. Authorisation: All returns require prior authorisation from Film Vibes. Do not return Goods without authorisation.
  2. Notification: You may contact us at Telegram/Instagram/Email within the Warranty Period to authorize a return.
  3. Inspection: The item must be returned to us for technical inspection. If we confirm a valid warranty defect we will, at our option, repair, replace or refund the purchase price (or offer a partial refund where appropriate).
  4. Remedy: We reserve the right to attempt repair or replacement before offering a refund. If repair or replacement is impossible or disproportionate, we may offer a price reduction or refund.

8.3 Return Shipping Costs

  • Buyer Responsibility: All return shipping costs are the responsibility of the Buyer unless we explicitly state otherwise in writing. Buyers are responsible for secure packaging and for choosing a trackable service and, where appropriate, shipping insurance.
  • Invalid Claims: If a warranty claim is found invalid, no refund will be issued, and you will be responsible for the cost of shipping the item back to you.

9. Limitation of Liability

To the fullest extent permitted by Singapore law, Film Vibes shall not be liable for any indirect, incidental, or consequential damages - including loss of data, film, images, or revenue - arising from the use of our Goods. Our total aggregate liability shall not exceed the purchase price of the specific Good(s).

10. Cancellations & Errors

10.1 Seller Cancellation

We reserve the right to cancel any Order (and refund payments already made) if:

  • The item cannot be sourced;
  • There was a genuine pricing or stock error; or
  • Payment is fraudulent or fails.

10.2 Pre-order Deposits

Pre‑order deposits are non‑refundable except where we cancel because we cannot supply the Goods.

11. Intellectual Property

All website content (text, images, logos, layouts) is owned by Film Vibes or used under licence. You may not reproduce, copy or distribute our content without written permission. If you believe your IP rights have been infringed, contact us at our email.

12. Force Majeure

We are not liable for delays or failure to fulfil orders caused by events beyond our reasonable control (events including war, pandemic, natural disaster, industrial action, transport disruption,supply chain failure, customs delays, supplier insolvency, etc.).

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

14. Changes to These Terms

We may update these Terms at any time without prior notice. The current version is always posted on our website with the “Last Updated” date. Your continued use of our website or placement of any Order constitutes acceptance of the revised Terms.
